Canal properties often have pools that back directly onto waterways. This adds particular complexity to fencing compliance — the fence must protect the pool area itself; the canal bank does not substitute as a barrier. Apartment buildings typically have shared pool facilities, which require body corporate compliance and carry a one-year certificate validity rather than two. Older properties in suburbs like Southport, Labrador, and Benowa often have pools built under earlier fencing standards that may need upgrades to meet current requirements.

Pool Density on the Gold Coast

Australia has one of the highest rates of pool ownership in the world. Queensland sits at the top of that list, and the Gold Coast is one of the most pool-dense regions in the state. The subtropical climate makes pools a year-round asset rather than a seasonal luxury — and that's precisely why pool safety certificates aren't treated as optional on the Gold Coast. They're a practical compliance requirement that surfaces every time a property changes hands or a tenancy starts.

Queensland law is specific about when a pool safety certificate is required. If you're buying, selling, or leasing a Gold Coast property with a pool, you need to understand what applies to you.

• Selling a property with a pool — The seller must provide a current pool safety certificate at settlement unless the buyer agrees in writing to receive a Form 36 (notice of no certificate). If the buyer accepts a Form 36, they take on the obligation to get the certificate within 90 days of settlement.
• Leasing a property with a pool — A current certificate is required before a residential tenancy agreement is signed — this applies to new leases and to renewals.
• After substantial work on the pool or pool fencing — If the pool itself, its shell, or its safety fencing has been significantly altered, a new certificate is required regardless of the existing certificate's status.
• Childcare and high-risk facilities — Properties operating as childcare centres or similar high-risk facilities must maintain a current certificate at all times.
• Certificate validity — Pool safety certificates are valid for two years for non-shared pools (a standard residential pool) and one year for shared pools (apartment buildings and properties with multiple occupancies). Check the expiry date on your existing certificate and book renewal before it lapses — re-listing, re-leasing, or any compliance audit will flag an expired certificate immediately.

Queensland's pool safety standard sets the baseline. For a Gold Coast pool to pass inspection, the fencing must meet:

• Fence height — Minimum 1,200mm from the ground to the top of the fence, measured on the outside.
• Gap requirements — No climbable gap greater than 100mm. This includes gaps at the base of the fence, between fence panels, and between the fence and any adjacent structure.
• Gates — Self-closing and self-latching. The latch must be on the pool side of the gate, positioned at least 1,500mm above ground, or otherwise inaccessible to a young child. The gate must swing away from the pool, not into it.
• Non-climbable zone — A 900mm clear horizontal zone on the outside of the fence. No garden furniture, planter boxes, or other structures within that zone that a child could use to scale the fence.
• Continuous barrier — The fence must form an unbroken barrier around the pool. Walls, doors, and windows can form part of the barrier under certain conditions, but each element is assessed individually against the standard.

Older properties throughout Southport, Labrador, Benowa, Biggera Waters, and the established canal estates often have fencing configurations that predate current requirements. An inspection will pinpoint exactly what needs to be remedied — nothing ambiguous, nothing open to interpretation.

Pool safety certificates are one of the first items to sort out when buying a Gold Coast property with a pool. If the seller is providing a certificate, check the expiry date — you want reasonable life remaining on it, not a document that expires two weeks after settlement.

If the seller is issuing a Form 36 instead, you're accepting the compliance obligation. That means booking your inspection within 90 days and getting the certificate in your name before the next lease or any re-sale.

If you're buying in a canal estate — Hope Island, Runaway Bay, Carrara, Varsity Lakes, Sovereign Islands — confirm that the pool fencing treats the waterway as the hazard it is, not as a barrier substitute. Canal-backed pools are common on the Gold Coast and they require careful assessment.

Pre-settlement is also the right time to check whether the pool has a current record on the Queensland Pool Safety Register. Every pool in Queensland must be registered — it's a separate obligation from the certificate itself.

If you manage rental properties on the Gold Coast, pool safety certificates are a recurring compliance item. A current certificate is required before every tenancy agreement is signed, including renewals.
